These Terms of Service ("Terms") govern your access to and use of Ophelia.AI (the "Service"), operated by Ophelia Studio ("we", "us"). By creating an account or using the Service you agree to these Terms. If you don't agree, don't use the Service.
1. Accounts
You must be at least 16 years old to use Ophelia.AI. You are responsible for keeping your login credentials safe and for all activity that happens on your account. Notify us at help@opheliastudio.site if you suspect unauthorized use.
2. Plans, billing & quotas
Ophelia.AI is offered on Free, Pro, Business and Enterprise plans with monthly project quotas (2, 30, 50 and custom respectively). Paid subscriptions are processed by Paddle, our merchant of record, and renew automatically until cancelled. Prices are in USD and may change with 30 days' notice. Quotas reset at the start of each billing month.
3. Your prompts and generated content
You retain ownership of the prompts you submit. Subject to your plan, you also own the digital products Ophelia.AI generates for you and may use them personally and commercially, including on marketplaces like Etsy. Free-plan exports include an "Ophelia.AI" watermark; Pro, Business and Enterprise exports do not.
You may not use the Service to generate content that is unlawful, defamatory, hateful, sexual content involving minors, infringes third-party rights, or is designed to deceive (e.g. deepfakes of real people). We may remove content and suspend accounts that violate these rules.
4. Our IP
The Ophelia.AI brand, website, software, prompts pipeline, and design system are owned by us and protected by intellectual-property laws. Nothing in these Terms transfers ownership of the Service to you.
5. AI limitations
Generated content is produced by third-party AI models and may contain errors, unexpected imagery, or similarities to existing works. You are responsible for reviewing outputs before publishing or selling them.
6. Termination
You can delete your account at any time from Profile → Danger zone. We may suspend or terminate accounts that breach these Terms or that we reasonably believe pose a security or legal risk.
7. Disclaimers & liability
The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim arose.
8. Changes
We may update these Terms from time to time. Material changes will be announced by email or in-app notice at least 14 days before they take effect.
